Terms of Service – Stormify

1. Scope and Seller Information

These Terms of Service apply to purchases of physical goods through the online store Stormify at https://www.stormify.de.

The seller and contractual partner is:

These terms apply to consumers and, where relevant, business customers. Mandatory statutory consumer protection rights remain unaffected.

2. Products and Availability

Stormify offers products as described on the respective product pages.

Product descriptions, essential characteristics, prices, and available variants are displayed before an order is placed.

We make reasonable efforts to ensure that product information is accurate. Product availability may change.

If an ordered product becomes unavailable, we will contact you and explain the available options. Any refunds legally due will be provided.

3. Ordering and Contract Formation

The presentation of products in our online store does not constitute a legally binding offer. It is an invitation to place an order.

You may select products, add them to your shopping cart, and review your order before submitting it.

You can correct your information using the editing options provided during checkout.

By clicking the final payment-obligation order button, you submit a binding offer to purchase the selected goods.

An automated order confirmation only acknowledges receipt of your order and does not, by itself, constitute acceptance.

The purchase contract is concluded when we expressly accept your order, for example through a separate acceptance or dispatch confirmation. If we accept your offer earlier by an unequivocal action, the contract is concluded at that time.

If payment is collected before acceptance and we do not accept your order, we will refund the amount collected without undue delay.

The contract language is German. An English version of these terms is provided for convenience.

4. Prices and Taxes

All product prices are displayed in euros (EUR).

The applicable tax treatment and any additional delivery charges will be disclosed clearly before you submit your order.

The total price payable is displayed during checkout.

No additional charges will be imposed without the customer's agreement where such agreement is required by law.

5. Payment Methods

The payment methods available for an order are displayed during checkout.

Depending on their activation and availability, these may include PayPal, credit or debit cards, Klarna, Apple Pay, Google Pay, or bank transfer.

Payment processing may be carried out by third-party payment service providers. Their additional terms may apply where disclosed.

For bank transfers, payment instructions and the applicable payment deadline will be provided during or after checkout.

Payment is due according to the selected payment method and the information provided during checkout.

6. Delivery Area

Stormify currently delivers exclusively to addresses within Germany.

We do not currently offer international delivery.

Any delivery restrictions will be displayed before the order is placed.

7. Delivery Times and Shipping Costs

The planned delivery time is 7–14 business days, unless a different delivery period is clearly stated on the relevant product page or during checkout.

Business days mean Monday to Friday, excluding applicable public holidays.

The delivery period begins in accordance with the payment method and the delivery information provided during checkout.

Shipping charges, if applicable, are displayed before you place your order.

If delivery is delayed, we will inform you where required and comply with your statutory rights.

Delivery estimates do not exclude or restrict mandatory rights relating to late or non-delivery.

8. Shipping Risk

For consumer purchases, the risk of accidental loss or damage generally passes to the customer only when the goods are delivered to the customer or an authorized recipient, subject to applicable statutory exceptions.

Stormify remains responsible for delivery in accordance with applicable German consumer law.

9. Right of Withdrawal

Consumers generally have a statutory right to withdraw from an eligible distance-selling contract within 14 days without giving a reason, unless a statutory exception applies.

The conditions, procedure, consequences, and model withdrawal form are set out in our separate Return and Refund Policy and statutory withdrawal instructions.

For a change-of-mind withdrawal, customers bear the direct costs of returning the goods where properly informed and legally permitted.

This does not affect the customer's statutory rights concerning defective or incorrectly delivered products.

10. Cancellations

You may request cancellation of an order before shipment by contacting stormify.de@gmail.com.

We will process the request if cancellation is still possible.

Once an order has been shipped, any applicable statutory withdrawal rights remain unaffected.

11. Statutory Warranty Rights

The statutory German warranty rights for defects (Gewährleistungsrechte) apply.

If goods are defective or do not conform to the contract, customers are entitled to the remedies provided by applicable law.

These may include repair, replacement, price reduction, withdrawal from the contract, or damages where the relevant legal requirements are satisfied.

Nothing in these terms excludes or limits mandatory statutory warranty rights.

Any additional commercial guarantee will apply only if expressly offered and will not replace statutory warranty rights.

12. Customer Information and Accounts

Customers must provide the information reasonably necessary to process their orders, including accurate delivery and contact details.

Customer accounts may be offered but are not generally required to exercise statutory consumer rights.

Customers are responsible for keeping their account login credentials confidential.

Personal data is processed in accordance with our Privacy Policy and applicable data protection law.

13. Intellectual Property

The content of our website, including original text, branding, designs, and images, may be protected by intellectual property rights.

Use beyond what is permitted by applicable law requires authorization from the relevant rights holder.

This provision does not restrict statutory rights or permitted uses.

14. Liability

Stormify is liable without limitation for intent and gross negligence, for injury to life, body, or health caused by a breach of duty, and in cases of mandatory statutory liability, including applicable product liability law.

In cases of slight negligence involving a material contractual obligation, liability is limited to foreseeable damage typical of the contract, insofar as legally permissible.

A material contractual obligation is one whose fulfillment makes proper performance of the contract possible and on whose fulfillment the customer may regularly rely.

Any other limitation of liability applies only to the extent permitted by mandatory law.

Statutory warranty rights remain unaffected.

15. External Services and Links

Our website may use services provided by Shopify and other third-party providers, including payment and shipping providers.

External websites may be subject to their own terms and privacy notices.

Nothing in this section limits Stormify's legal responsibilities toward customers.

16. Privacy

Information about the collection, use, and protection of personal data is available in our Privacy Policy (Datenschutzerklärung).

17. Changes to These Terms

We may update these Terms of Service for future orders.

The terms applicable to an order are generally those incorporated into the contract at the time the order is placed.

Changes to these terms do not automatically alter existing contracts without a valid legal basis.

18. Applicable Law

German law applies.

For consumers, this choice of law does not deprive them of any mandatory protections that apply under relevant law.

Mandatory statutory rules concerning jurisdiction remain unaffected.
